Hello, my husband is in month 57 of 60 of his IVA and is due to receive a payout for medical negligence and i was wondering if the IVA practitioner would be able to take any? I also received a payout about 3 years ago whilst i was in an IVA and was told told i didn't need to pay anything in because it was for pain and suffering, they have also started proceeding to the review of my property with just 3 months to go, i thought this should have been done at month 54?

Hi BantamT.

There's no straightforward answer to offer you about a medical negligence claim. Your husband should contact his IVA supervisor who will then assess the facts and determine what should happen next.

Perhaps the review of your property might have started a little earlier, but I'm not sure that this should cause you any additional problems.

Thanks for your reply, when they do a review of my property for my husbands IVA would they be able to make me remortgage even though i'm not in an IVA anymore, i did a F&F last year, the house is in a join mortgage, why should this have an impact on me when it's not me in the IVA?

Hi BantamT.

I don't suppose it would be possible to force you to enter into a new mortgage which would help to release some of your husband's share of the equity in the home.

The consequence of a refusal might be the failure of the IVA though, which could lead to more serious risks all around.

Your share of the equity should be left alone.

It's very often impossible to release any equity by way of a new mortgage, so this concern might be academic anyway.
